Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legal agreement between you, the business ("Client"), and We Host KC ("Provider", "We", "Us"), governing your use of We Host KC's payment processing portal ("Service"). By using the Service, you agree to be bound by these Terms.

2. Services Provided

We Host KC provides a secure platform to facilitate processing of financial transactions, enabling businesses to build recurring funding streams. We act solely as a payment processor and platform provider and do not guarantee business growth, sales, or fundraising outcomes.

3. Processing Fee and Payment Terms

• A processing fee of percent (26%) is applied to all funds received through the Service. This fee covers all payment processing activities and disbursements.

• The fee does not cover chargebacks, site maintenance, or non-payment processing activities.

• No monthly or subscription fees apply.

• Processed donations/funds will be disbursed on or about the 15th day of the month following receipt to allow adequate time for donor/member fund clearance and chargeback monitoring.

4. Transaction Processing and Disbursement

• We Host KC will process received payments in accordance with payment industry standards and applicable law.

• Funds processed and cleared will be disbursed to the Client per the schedule noted above.

• The Client is responsible for monitoring fund receipt and reporting any discrepancies promptly.

5. Chargebacks, Refunds, and Disputes

• Chargebacks or disputes initiated by donors or payment providers will be handled per standard industry procedures.

• The Client acknowledges responsibility for all chargebacks and associated fees outside of the 26% processing fee.

• Refunds to donors/members must be handled by the Client directly unless otherwise agreed.

• We Host KC reserves the right to withhold disbursements to cover chargebacks or disputed amounts.

6. Security and Compliance

• We Host KC complies with the Payment Card Industry Data Security Standard (PCI DSS) to protect all sensitive payment data transmitted through the portal.

• The Client agrees to cooperate with any reasonable security measures implemented to safeguard payment information.

• The Client will maintain confidentiality of login credentials and notify We Host KC immediately of any unauthorized access.

7. Limitation of Liability

• We Host KC provides the Service "as is" and makes no warranties regarding business outcomes, fundraising success, or performance.

• We shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Service.

• The Client assumes full responsibility for compliance with applicable laws regarding the collection and use of funds.

8. Termination

• Either party may terminate the Service agreement at any time by providing 90-day written notice.

• Upon termination, all pending funds will be processed according to the terms outlined herein.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which We Host KC operates, without regard to its conflict of law principles.

10. Amendments

We Host KC reserves the right to update or modify these Terms at any time. Continued use of the Service after changes constitute acceptance of the updated Terms.

By using the We Host KC payment processing portal, you acknowledge that you have read, understood, and agreed to these Terms of Service.

We Host KC reserves the right to update, modify, or change these Terms and Conditions at any time, with minimum to no prior notice. It is the responsibility of users to review the Terms periodically to stay informed of any updates. Continued use of our services after any changes constitute acceptance of the revised Terms and Conditions.
